【綜合報導】中國廣西壯族自治區內的侗族村民，9日舉行傳統「牽牛上樹」的祈福儀式，以祈求風調雨順，五穀豐登，國泰民安。

村民合力將黃牛捆綁好，接著將牛往樹上拉，一直到吊死牠為止，這項習俗在當地已經流傳470年，在每年農曆6月2日舉行，同時也有警示村民要奉公守法的意味。

不過這項傳統看在外國媒體眼中，就變成可怕的屠牛儀式，圍觀的村民還興高彩烈，等著看黃牛斷氣，顯示各國民情風俗不同，也難怪外國媒體感到如此訝異。

洪下士的死反應的不僅是國軍內部制度設計上的殘缺，更是制度內的集體冷漠文化。以制度設計紊亂來說，近日報載士官不能被關「禁閉」，國防部澄清說士官的確不能被關禁閉，但是可以「悔過」。然「悔過」的執行實際上又與禁閉無二異，讓人懷疑，這種名異實同是由於人為的解釋凌駕於制度本身，由來已久的慣例所造成。以筆者經驗，類似的慣例在軍中作用甚大，久而久之也就沒有人去追究制度的本意了。造成制度不過是「人為解釋慣例」的包裝，而這種可以任意解釋的「人為慣例」才是真正有權力的地下潛規則。
 
此外，集體冷漠或許才是這次慘案的主因。在軍中，像是士官「悔過」此嚴重懲處，至少要經過三層的主官、主管、幕僚簽核才可執行。軍中本設有政戰人員進行官兵心理風險控管、同理心方式輔導、對主官決定進行諫言，不可謂沒有防範設計，但重點在於要確實進行上述任務，必須有干犯集體陋習的勇氣，如果缺乏此等勇氣，那麼也只是遮羞布而已。難怪一出事，軍中處理的第一要務往往是拿出切結、心輔、晤談等資料來切割責任，完全違背了制度設計的意義。
 
以「士官評議委員會」的設計來說，雖然名稱上是委員會，但實際上參加的都是四周的利害關係人士。在集體冷漠文化裡，貫徹的是人脈決定懲處輕重的事實。一個案件可以輕輕放下，也可以像是人脈淺薄的義務役常遭受到的惡整。從士官評議委員會，到軍醫院體檢報告、禁閉室進行操課，每一層、每一級都負有責任，但可怕的是這反造成「集體不負責」的弔詭現象、「結果與我何干」的集體冷漠文化！
 
筆者深信，軍中也存在著擁有道德勇氣的吹哨者（whistleblower）。如何重視這些舉報，追蹤改革的方案與進度、引進外界的改革與監督力量、保護吹哨者的工作權與生命財產安全，恐怕已是長久處於封閉與黑箱結構內的國軍當前所不得不面對的重要課題！
