為豐田等提供汽車零組件的大型企業——雙葉產業的前專務被逮捕。罪名是涉嫌在該公司中國工廠的經營過程中向當地政府官員行賄。這是在當地擁有網點的企業都可能面臨的中國風險。

9月11日，豐田汽車零件供應商雙葉產業的前專務因涉嫌向中國廣東的政府官員行賄、觸犯了日本《反不正當競爭法》而被逮捕。

雙葉產業今年曾因向子公司非法貸款接受了警方搜查，此次行賄事件就是在這一調查中被發現的。該公司成了日本第三家因賄賂外國公務員而違反《反不正當競爭法》的企業。從事件的背景來看，進駐中國的很多日本企業的一個共同風險浮出了水面。

「在這裡，大家都這樣做」

此次事件發生在廣東省東莞市。在臨近的深圳市經營工廠的某日資企業的當地子公司的高管透露說，「多數企業或多或少都在向官員送禮或請客」。

對日本企業來說，中國業務伴隨著賄賂是普遍現象，尤其在廣東省，從體制上來說就非常容易造成官員受賄，原因就在於當地「來料加工」這種加工貿易制度。

按照這種制度，外資企業能夠以零關稅進口設備和材料，前提是，生產的產品原則上全部要出口。在中國，這是與香港毗鄰的廣東省獨有的制度，曾經是中國作為「世界工廠」實現快速發展的根基。

這其中隱藏著一個漏洞。在加工貿易中，企業要把生產委託給地方政府經營的工廠。因為直接關係到稅收和增加就業，地方政府在招商時經常提供優惠的條件，在遵守稅務和勞務相關法律規定方面睜一隻眼閉一隻眼。而且，法律與執行之間本身就存在差距，難免出現一些「灰色地帶」。
