立院三讀　藥師有條件不限一處執業

《藥師法》第11條原訂「藥師執業以一處為限」，遭大法官宣告違憲。立法院今天三讀通過《藥師法》修正案，執業登記於醫療機構或藥局的藥師，若從事藥癮治療或傳染病防治服務、義診、巡迴醫療、藥事照護或其他經中央主管機關認定公益或緊急需要等，可合法於他處執業，不受一處限制。

由於西醫師劉泓志與社區藥師楊岫娟、蔡美秀等人，因面臨藥師家屬去世或生病狀況，請求衛生局核准支援遭拒，因而聲請釋憲。2013年7月31日司法院釋字第711號解釋，藥師法限制藥師僅能於一處執業規定，對藥師執行職業自由形成不必要限制，有違中華民國憲法比例原則，牴觸憲法保障工作權意旨，應自解釋公布日起，至遲於屆滿1年時（下月31日）失效。
 
因此行政院提案修法，但修法引發醫師、藥師論戰，藥師公會也為此上街頭抗議；今天立院朝野協商獲共識，順利通過《藥師法》修正案。（陳培煌╱台北報導）
