男害5命判死 律師舉鄭捷案例

（中央社記者劉世怡台北11日電）男子彭建源被控縱火燒死5人，高院更一審判他死刑。最高法院今天開準備庭，彭的律師舉鄭捷在捷運殺人案為例，主張有精神疾病者，應審酌有無判死刑的必要。

彭建源家住新竹市，因為有事想找周姓結拜兄弟幫忙，但周男以家中有人、不便外出等理由拒絕。彭男不滿好友不顧結拜情誼，民國101年3月間至周男所在的鐵皮屋潑灑汽油縱火，造成屋內5人來不及逃出活活燒死。

彭男一、二審均判死刑，上訴最高法院後，遭撤銷發回，高等法院更一審仍判死刑，彭男一心求死、不提上訴，因本案依法屬強制上訴案件，高院代為上訴三審。

最高法院今天開準備庭，彭男的律師主張，法院應將被告的病史和精神狀況列入科刑辯論範圍，才符合保護人權精神，也舉鄭捷殺人案為例，主張有精神疾病者，應審酌有無判死的必要。1030711
