都市道路用地可轉換成容積率移轉嗎?

有建商要來挖掘我家走廊外連接道路的斜坡車道，約1公尺，是跨過市政府沿著走
廊鋪設的社區排水溝，大約有20家有相同狀況。他聲稱我們侵佔他的土地，連排
水溝都屬於他的地。
此道路早就是道路用地，超過50年。此道路是我父親時代被政府無償取走的。我
要問的是:
1. 道路用地可以變成 <都市計畫容積率移轉> 嗎? 法規容許嗎?
2. 如果市政府要把道路移轉給私人，那麼悠關我家進出的道路(我家正門前)，我
有優先權承購吧! 否則那天人家要砌一堵牆起來，排水溝也堵了，我就無語問
倉天了。
3. 上述情況要詢問中央那個單位? 地方單位不可信(桃園市)。懇請高手解惑。
