陳毅銘無犯行 湮滅證據不起訴

桃園地檢署襄閱主任檢察官戴文亮說，湮滅證據是開始偵辦以後，才構成，但禁閉室這6天期間並未開始偵辦，不屬於法定要件範圍內，因社會疑慮，所以積極偵辦。

戴文亮說，傳訊相關證人，都指陳毅銘並未事後指示他人刪除檔案，「根本沒檔案可以刪」，或是事前叫通訊兵拔插頭、按電源等行為。

他說，可以確認7月1日黑畫面完全沒檔案，雖有人為維修，把電力中斷情形發生，「是非蓄意行為」，雖造成檔案未存檔，但沒人為竄改，7月3日黑畫面是電力不穩造成。

戴文亮說，全案沒有湮滅證據犯行，對陳毅銘不起訴處分。
