依據勞委會日前公告，自103年1月1日起，每小時基本工資將由現行109元調整為115元；7月1日起，每月基本工資由19,047元調整為19,273元。勞資雙方約定之每小時基本工資如有低於調整後之基本工資者，應自103年1月1日起依法調整。

勞委會強調，勞雇雙方約定之工資，不得低於基本工資。雇主如違反基本工資規定，一經查獲，除可處新台幣2萬元至30萬元之罰鍰外，主管機關亦得視情況公布事業單位或事業主之名稱、負責人姓名。

此外，雇主仍應補足工資。勞工如有權益受損者，可就近向當地勞工行政主管機關【各縣（市）勞工局或社會局（處）】或勞委會專線（0800-085151）申訴，將立即依法查處。
