機車撞行人

11月11日我走在斑馬線上被一台機車撞了，今天12月10號開了調解會，撞到我的人竟然說要包給我3600就想要和解，他還說他修車修了九千多塊，真是讓我很火大。(原來人命那麼便宜哦，車子都修九千了，包個3600就想和解)

醫生證明：韌帶撕裂傷+膝蓋僵硬，因為還在復健，所以醫生說無法估要休養幾天。

事件：閃黃燈的十字路口，公車橫著過到了一半，機車直行為了超過公車，所以就逆向超車撞上了走在斑馬線上的我

請問我要準備什麼東西才能讓他賠他應賠的錢呢??請問他在法律上要付什麼要的責任嗎??我因為車禍所以無法去日本，退票的錢可以跟他請嗎??
